Overview

In this case study, we delve into the intricate details of how Metis HR provided invaluable assistance to a kitchen company facing a complex people situation. The client approached Metis HR when confronted with a sensitive situation. They had a pregnant employee who was alleging discrimination and bullying. The client did not want to get things wrong. They had never dealt with this issue before and wanted support.

The employee, a sales rep, who was responsible for visiting clients’ homes, had refused duties, engaged in offensive language, and created disruptions in the office environment. They received a grievance filled with strong accusations and the threat of a tribunal claim due to the employee’s pregnancy. This put the employer in a very difficult positon.

Metis HR initiated a thorough consultation with the client to understand the actions n the employer had taken so far and assess the impact on the business. The comprehensive HR support provided by Metis included the following:

Scripted meetings and grievance procedure – To streamline communication and ensure a fair grievance procedure, Metis HR provided scripted meetings and drafted relevant questions for the client.

Scenarios for employee meetings – Recognising the potential sensitivity of the situation, Metis HR talked with the client about various scenarios to anticipate in the grievance hearing and how best to respond to the employee during the meetings.

Focus on performance issues, not pregnancy – Metis HR helped the client to explain the reason that they required the employee’s behaviour to improve. This included clarifying that this was not due to the employee’s pregnancy, as claimed. Instead, the focus was on the sales rep’s failure to fulfill duties their duties. By not working effectively as part of a team, and the potentialy damaging the client’s reputation.

Outcome

Throughout the process, Metis HR worked closely with the client. This involved guiding the client through the intricacies of handling a pregnant employee’s grievance and addressing performance issues. By minimising potential risks, we ensured the right outcome was achieved.
